Texas Enables Removal of Discriminatory Provisions from Conveyance Instruments

Texas enacted the Senator Royce West Act, which amends the Texas Property Code to include streamlined procedures to modify a deed in order to remove discriminatory provisions from recorded conveyance instruments.

The Act provides template language to request the removal of discriminatory provisions from a deed. In addition, the Act lists the procedures the relevant courts must follow to process such filings. Once a motion is filed, if the court does not rule on the motion on or before the 15th day after it was filed, the motion will be deemed granted. The Act is effective September 1, 2021.
